County jail time (where he's probably going) is a little different from Department of Corrections/prison time. While prisoners do rape each other in prison, a sentence in prison is by far no guarrantee of coerced sexual contact with other inmates. Inmates in County are a pretty well supervised group with less access to freedoms one might find in prison, like exercise or smoking.

I've sent people to prison, not county, for doing very much the same thing. In my state, there is actually a specific charge for that crime. I don't know about Florida.

@EVERYBODY ON JALOPNIK: This has to be one of those rare times where I think the punishment actually fits the crime, the Bollea kid gets eight months and suspended from driving for three years. The other kids gets to stay in bed for the rest of his life (wow! how lucky is he?).

My mother was killed by a drink driver in his early 20's, who hit her old Fairlane with an SUV while he was trying to v-max it on a two-way urban street. He survived because his SUV had crumple zones and air-bags. My mother had to be identified by dental records.
This kid's attitude while he's in court was "what was she doing there in the first place?" while his family and friends taunted my family, and it was the third time he'd been busted for drink driving.
...And the little cunt gets 4 years in the big house and 5 years off the road, arranged so when he gets out he only has a year off the road before he can drive again.

We all make mistakes, I personally have been done for DUI (PCA). But I learnt my lesson, got punished and am grateful nobody was hurt or killed. Bollea's attitude reflects the sentence he got and I think that's fair.

Weather it is actually what happens or not the common belief is that you go to prison, you get stuffed in the ass. The fact that this is as large a deterrent as being locked in a cell, and that that deterrent is almost capitalized on is frustrating. I was out in the middle of nowhere, going 60 in a 50, I wasn't racing, nobody got hurt, and the only thing that was damaged was my car.

Now if I could even face those kinds of penalties for what I did, I think the punishment he got was quite appropriate. He was traveling far in excess of the limit, on a city street, in traffic, while racing, and someone got seriously injured. Now the fact that the person injured was the passenger and knew what was going on diminishes how severe the punishment should be, and it did, he wasn't sentenced anywhere near as harshly as he could have been. The article says he could have faced up to FIVE YEARS in jail.

I am going to agree that the Graziano lawsuit is bullsh*t though.

As much as I feel sorry for his family, John Graziano willingly got in the car and didn't wear his seatbelt. Also, the City of Clearwater has made many of the roads around here much more dangerous than needed, by planting huge palms in the medians in the name of beautification. I am constantly reading about the many deaths on the roads around here from crashing into palm trees. They plant them 3 feet from the road edge, and a palm tree will win every time. That is not to say that Bollea isn't guilty, but a combination of circumstances led to the injuries that Graziano sustained. Minus about 433 horsepower, I drove somewhat like a douchebag when I was 17. My '77 Civic wasn't capable of breaking the rear tires loose at 60. Maybe somewhat because of that I have a little empathy for him.
