All the offroad- race use stuff, is for non CARB approved mods. That being said most of the mods will still pass smog, and honestly when was the last time a car failed a visual inspection.

As for this engine in a street car.. you are going to roll the dice, assuming that it still passes smog you might be able to get away with it in some states. CA would be a HUGE dice roll...

The engine is not EPA approved in that trim.
I own a Mystic/Over Imola... The 3 series is considered an entry level Luxury car... If a 911 is a Luxery car so is the E46... Yes it is raw, but still drivable over long distances. It has also been called a Punk Rocker in a Tux... I like that name...

Faster then the same year non Turbo 911, and still faster then any Caiman but the R. Useable back seat and huge trunk.

low $20's for a well maintained low mileage >60,000mile car. Cheaper if you are willing to go for pre 04 cars with 80-110k miles. Think $18k!

0-60 in 4.8 and a 12 second quarter, plus you get the most reliable 3 e46 according to consumer reports, and the sublime s54b32 engine.

Downsides are the valve adjustment service every 24k miles, @ about 1,500 bucks...

Sorry I should have said High reving, ITB's with peaky powerbands focused towards the redlines. If you look the e9x is not very peaky, in fact while the v8 has 70 plus more hp it only has about 20 more pounds of torque... seems odds since it gained .8 liters... For some reason while the e9x can rev and make HP it really does not put out as much torque as it should, once you drive one esp if it is back to back with an e46 it really feels like it is missing something. that being said it is a faster car, just not as rewarding to drive.

I have been lucky enough to own and or drive many M cars. The E9X may be faster then the e46 but it is no where near as fun to drive. Plus the e9x feels way down in torque. The S54b32 is an amazing engine, nothing really compares to it, except maybe the s2000 and rx8. But those are both slower cars, there is a magic to an engine that makes power only above 4k rpm. In the S2k and Rx8 they feel underpowered at low revs, in the e46/z4m/later z3mc with the s54b32, has more then enough power down low, but hit 4k rpm and the car takes off like a scalded cat.
The e39M is an amazing car, it feels light, and it almost a sports car. The e60M is a monster do not get me wrong, but the car is heavy and it is more of a grand tourer.

The e46 and e39 (as well as the e30) M cars all whisper in your Ear "do bad things/hold the revs a little longer/there is not a cop on that onramp..." the E9x and E60 M's are fast but not really magic feeling.

M cars and M badged are 2 different things. There was the 535M car from the 80's which was not technically an M. M badged is ok. On the other hand M cars should be high revng naturally aspirated cars preferably with ITB's. Under that reasoning the last true M cars where the e46 M and e39M. Those are really the last cars true to the M soul. Sure the E60 and E9x are good cars but they do not capture your soul like the earlier cars.

M is not dead, just something different. It is a little sad, but with CAFE and other MPG restrictions there just was no way not go FI...
