Unique Performance Customers Suing Carroll Shelby

Having invested millions of dollars in cars that, if they were ever started, have probably been auctioned off or are sitting in an evidence locker, at least two Unique Performance customers have put together a lawsuit against Carroll Shelby. Why? Shelby licensed his name to some of the vehicles. To his credit, Shelby did pull his licensing agreement after receiving complaints. But was he paid royalties? How long did he know? We're not sure if these suits will have standing, but so far we've yet to get a comment out of Carroll Shelby and are awaiting a comment from his lawyer. [CBS-11]

  • I really feel bad for the people who got suckered into fronting cash for these things, and I'd love it if they could get their money back, but really? Sue Carroll Shelby? Is Chip Foose next? That's just shitty.

  • Yea this should kick ole Carroll's ticker a little. Its amazing how fast this thing went from really cool to really bad. If I had taken that kind of money from people to build a car, and not given them anything, I would be sleeping with the fishes, so to speak...

  • All of the litigiousness in this country has to end sometime. It's clear that these "buyers" were victims, and it is someone's fault.

    Sadly, that someone hasn't the funds to repay, so a [sarcasm] brilliant [\sarcasm] lawyer decides to go after the only party left with the means of reparations.

    It IS someone's fault. Carrol Shelby is not that someone.

    It's sad that they have lost (likely) a lot of money, but that doesn't entitle them to take it back from somemone who didn't take it from them. If someone steals my car, I can't lay claim to my neighbor's car to "set things right".

    It's just the Karmic Wheel in action. In his long life, Carrol Shelby has managed to sue just about everyone east of the Pacific and north of the Rio Grande.

    Also, if it's not obvious by now, I should like to point out that suing people is all about getting cash settlements, not justice. So you sue whoever has the money. Carrol Shelby has money.

    Ipso facto, quid pro quo, cogito ergo sue 'em.

  • It will be interesting to see if Carroll and even Chip had any prior knowledge of what was going on. This stuff didnt just show up overnight, it appears it went on for months. I would hate to think these guys collected royality money for cars that were never built. Could get much uglier.

  • Man, there are a lot of commenters on Autoblog trashing Carroll Shelby for being a greedy, irresponsible sonofabitch.

    I'm not old or lucky enough to know Shelby's whole life story, but one thing I do know is that he really doesn't stop at any opportunity to make a quick buck. But just one at a time. Come on, you can't call this guy truly greedy when he licenses out his name to clubs for $1 per year. Also, I think there's some loophole where he's not guilty because of his mental condition...something to do with his brain being permanently squashed into the back of his skull as a result of driving that 800HP Cobra.

  • They are simply going for any money source to get back their losses, even if Shelby isn't the one who screwed them. Some lawyer said "yeah we can get it from him" because even if they lose, the lawyer gets paid anyway. They don't take cases like this on contingency.
    First off, Shelby isn't desperate for money, he didn't get involved in this as a money grab, I'm sure he really thought they were going to make terrific cars. And as someone who has licensed products before, he had no way of knowing everything that was going on there. People operate in good faith and he didn't buy that shop, he licensed his name to it. Please don't tell me that if Nike went out of business that stores who paid for sneaker shipments could go after Micheal Jordan in court for his endorsement for the shoes they were due.

    It's a money run, by a lawyer who is going to get a payday anyway and told his clients that they had a good chance of getting their money back. It will get tossed, and the car buyers will be out that much more. Geez look at all the people who got screwed at Enron. Bad things happen in life.

  • @ranger88: You need to do some homework my uninformed friend. Shelby cares about money only. Ask anyone that has done Business with him previously. Ask: Brian Angliss, or Mike McClusky, or Ford, or Kirkham, or the SAAC, or anybody else.

    You may have known that Brent Fenimore, formerly of shelby american(Now defunct after being steered into bancruptcy) was one of the higher ups at Unique performance prior to their problems.

    It's really no surprise that Unique was a carbon copy of shelby Automobiles. A lot of false promises to customers that feel like they need this particular car to complete their life. Suckers.

    Shelby seems to have the deepest pockets in this latest case of car capers. It is fairly easy to believe that he will be named in any or all of the suits filed, because he may be complicit in all the bad business that went on.

    And all the negative comments, he's earned them.

  • Yep, agreed; Shelby has stretched a remarkable legacy out of what is, objectively, little more than a chili recipe and a propensity to litigate.

    The guy has been riding the Cobra legacy (which, to Ford's credit, they've let him take more than his share of credit) for as long as he's been milking this bad heart routine- Shelby is simply a promoter, and as such, may very well have put himself in the line of fire with Unique;

    Eventually, the hustle always comes to an end.
